YOUR CONSENT TO ELECTRONIC DELIVERY

(“Consent Statement”)
 
You are applying for a BloFin Wallet Card. If you consent to this Consent Statement for this card program (the “Program”), this Consent applies even if you do not obtain (or are not offered) a BloFin Wallet Card.
 
Your affirmative consent to this E-Sign & Electronic Communications Notice (“Consent”) permits BloFin Wallet to provide you with disclosures, notices, and other communications (collectively, “Communications”) electronically. This Consent also enables you to sign and authorize Communications electronically through the BloFin Wallet dashboard, APIs, or related services (collectively, the “Platform” or “Service”), and allows BloFin Wallet and its partners, including its card program service provider, Rain, to collect and rely on such electronic signatures.
 
If you do not consent to electronic delivery of Communications, you will not be able to use the Service. By registering for a BloFin Wallet account, applying for a BloFin Wallet Card, or accessing the BloFin Wallet Platform, you agree that such actions constitute your electronic signature. You further consent to BloFin Wallet providing Communications to you, your company administrators, and company users (if applicable), including those required by law, in electronic form. You understand that this Consent has the same legal effect as a physical signature.
 
You have the right to receive legal disclosures, notices, and communications (together, the “Covered Items”) in paper form by mail. We may instead provide these Covered Items electronically if you give your Consent and satisfy the System Requirements described below. Covered Items include, without limitation, all servicing and account-related communications, collection notices, and any disclosures or notices that BloFin Wallet or its issuing and processing partners are required to provide in writing in connection with your BloFin Wallet Card account.
 

Definitions

In this Consent Statement, “we,” “us,” and “our” refer to BloFin Wallet and its service providers, including Rain, the card program service provider.
 

Duration of Consent

Your Consent will remain effective until:
  1. You or we terminate your participation in the Program or your BloFin Wallet Card; or
  2. You withdraw your consent to receive electronic Communications.
If your Card is terminated, this Consent will continue to apply with respect to any rights or obligations that arose prior to termination, including those created by your acceptance of this Consent Statement. Please refer to your cardholder agreement for details on how to terminate your Card.
 

Methods of Providing Covered Items

“Provide” means to deliver, make available, send, notify, or a similar action. Covered Items may be provided electronically through the Platform, via email, or by making them available for download (including in PDF format). It is your responsibility to review Covered Items promptly and take any required action.
 

Access to Paper Copies

You may print or save copies of Covered Items using the functionality of the application in which they are viewed (for example, a web browser or PDF reader). We retain copies of Covered Items for the time periods required by applicable law and will provide copies upon request during those periods. We do not necessarily retain records beyond legally required retention periods.

Our Right to Send Paper Communications

We reserve the right, at our discretion, to provide Covered Items in paper form even if you have consented to electronic delivery. This may occur, for example, in the event of a system outage or suspected fraud.
 

Hardware and Software Requirements

To access and retain Covered Items electronically, you must have:
  • A device with working Internet access
  • A web browser that supports 128-bit encryption (including the latest versions of Chrome®, Firefox®, Microsoft Edge®, or Safari®)
  • At least 16 MB of available memory (32 MB RAM recommended)
  • Software capable of viewing, saving, and printing PDF files (such as Adobe® Reader® version 4.0 or higher)
By providing your Consent, you confirm that you meet these System Requirements.
 

Acknowledgment and Consent

By confirming that you have read and agreed to this Consent Statement, you acknowledge that:
  1. You have access to a system that meets the requirements described above;
  2. You consent to receiving Covered Items electronically; and
  3. You are able to access, retain, and print or store the information provided.
